In compliance with the Federal Law of Personal Data Protection in Possession of Private Persons, its Regulations and the Privacy Notice Guidelines, we hereby inform to you the following:
RESPONSIBLE OF THE TREATMENT OF PERSONAL DATA
BLAZKI, S.A. DE C.V. and its affiliate and/or subsidiary companies, hereinafter, GRUPO PUEBLO BONITO, with domicile at Avenida Ernesto Coppel Campaña S/N, Zona Nuevo Mazatlán, C.P. 82100, Mazatlán, Sinaloa, Mexico; is responsible of the treatment of your personal data, the use and protection thereof, pursuant to this Privacy Notice.
PURPOSES OF THE TREATMENT OF THE PERSONAL DATA
The personal data in possession of GRUPO PUEBLO BONITO with respect to its clients will be used for the following purposes that create and are necessary for the existence, maintenance and compliance of any legal relationship between GRUPO PUEBLO BONITO and its clients (hereinafter referred to, individually, as an owner):
- Rendering of booking and lodging services, as well as to process, update, modify and cancel the services through any means of communication: telephone, internet, electronically or in person.
- Rendering of restaurant services and meal packages.
- Rendering of banquet services.
- Rendering of organization of events services.
- Rendering of touristic and commercial services.
- Rendering of SPA services and for prevention purposes in case any client has a special health condition, which must be informed to GRUPO PUEBLO BONITO. In these cases sensible personal data may be requested so as to analyze if the client is under any physical or medical treatment that may restrict his/her participation in any treatment of the SPA and/or special care when rendering other type of services.
- Improve or satisfy the needs of the clients and the services provided.
- Perform direct or online bookings and apply the necessary charges for the corresponding rendering of services and any other charge that is required pursuant to the purposes established herein.
- Send e-mails or make telephone conferences in order to confirm the data related to the bookings that were made, to receive offers or request identity documents of the client or the owner of the credit card, if necessary.
- Manage memberships, including the processing of data for invoicing purposes, management of accounts, prepare the history of transactions; apply discounts and perform the clarifications and investigations that are required.
- Make charges, collections, refunds or reimbursements.
- Inform the aspects related to memberships and possible benefits.
- Comply with the obligations related to the foregoing services.
- Maintain adequate communication with the clients.
The treatment of the personal data will be limited to the compliance of the purposes set forth in this Privacy Notice and to different purposes that are compatible to those established herein, without requiring to obtain again the consent of the owner and subject to the limitations set forth in the applicable legal provisions.
ADDITIONAL PURPOSES THAT DO NOT IMPLY A LEGAL RELATIONSHIP AND THAT ARE NOT REQUIRED FOR THE RENDERING OF THE SERVICES
Additionally, the personal data of the clients may be used for the following purposes that are not necessary for any legal relationship between GRUPO PUEBLO BONITO and its clients, but allows and facilitates us to provide better assistance:
- Inform on new services, products or events related to the abovementioned services, including advertising newsletters, surveys and changes sending.
FORMS FOR OBTAINING PERSONAL DATA
For the purposes established in this Privacy Notice, GRUPO PUEBLO BONITO may obtain the personal data of any client by several forms:
- When the information is directly provided by the client.
- When the client visits the web sites of GRUPO PUEBLO BONITO.
- When the client uses the services offered by GRUPO PUEBLO BONITO
- When we obtain information through means different to those abovementioned and is permitted by the applicable legal provisions.
PERSONAL AND SENSIBLE DATA
The personal data obtained through the abovementioned means may be: name, domicile, zip code, city, country, e-mail, telephone number, nationality, age, date of birth, marital status, Population Code (CURP), family data, Federal Taxpayers´ Registry (RFC) or tax identification number, personal references, profession, occupation, education, as well as financial and property data, such as credit history, credit or debit cards, including the name of the holder, card number, date of expiration and security code, and consequently GRUPO PUEBLO BONITO will be responsible of the treatment of the financial and property data of the holder.
In addition to the personal data mentioned in the paragraph above, for the purposes set forth in this Privacy Notice, GRUPO PUEBLO BONITO may obtain and treat sensible data for the rendering of the SPA services and for prevention purposes in the event that any client presents a special health condition that the owner must or desires to inform to GRUPO PUEBLO BONITO.
Such sensible data includes racial or ethnic origin, current or future health condition (pregnancy, high or low blood pressure, claustrophobia, presence of any metallic piece in the body, pacemaker usage, diabetes, cancer or any other disease, allergies, recent surgery and type thereof, blood type), genetics, religious, philosophical and moral beliefs, and sexual preferences.
GRUPO PUEBLO BONITO obliges to treat the personal and sensible data with strict security and confidentiality.
TRANSFER OF PERSONAL DATA
GRUPO PUEBLO BONITO may transfer the personal data in its possession to companies that pertain to the same corporate group.
In addition, GRUPO PUEBLO BONITO may transfer the personal data to third parties subcontracted or related to the rendering of the services, for marketing purposes or for market studies inside or outside the country, and in some cases we may provide information to credit card companies or bank institutions in order to perform clarifications regarding undue charges or charges improperly applied deriving from the rendering of the services and the activities of the GRUPO PUEBLO BONITO.
Such third parties will assume the same obligations as GRUPO PUEBLO BONITO, and therefore the treatment of the personal data will be performed pursuant to this Privacy Notice.
MEANS TO EXERCISE ARCO RIGHTS (ACCESS, RECTIFICATION, CANCELLATION AND OPPOSITION)
In order to get access the personal data that GRUPO PUEBLO BONITO possesses, as well as to rectify such data if they are inexact or incomplete, or to cancel or oppose to the treatment thereof for certain purposes, please submit a request in writing by e-mail addressed to our Personal Data Department to email@example.com or a notification in writing to Blazki, S.A. de C.V. with domicile at Av. Ernesto Coppel Campaña S/N, Zona Nuevo Mazatlán, C.P. 82100, Mazatlán, Sinaloa, Mexico, addressed to the Personal Data Department, Monday to Friday from 9:00 am to 6:00 pm, containing the following information:
- Name of the owner
- Domicile of the owner or e-mail so as to send the response to the request.
- Documents that prove the identity or authority so as to represent the owner with respect to the request.
- Description of the personal data with respect to which any ARCO right is intended to be exercised.
- Any other element that allows the localization of the personal data and processing of the request.
If the request does not satisfy any of the abovementioned requirements, the Personal Data Department may require the owner or his/her legal representative within 5 days of reception of the request to submit the necessary elements or documents so as to process the request. The client will have 10 days to fulfill the requirement, otherwise the relevant request will be considered as not submitted.
The response to the request via e-mail will be made within a term of 20 days after its reception, and will be effective within a term of 15 days after the communication of the response.
MEANS TO REVOKE THE CONSENT
At any time the consent granted to GRUPO PUEBLO BONITO to treat your personal data may be revoked by sending a request in writing by e-mail addressed to the Personal Data Department firstname.lastname@example.org or a notification in writing to Blazki, S.A. de C.V. with domicile at Av. Ernesto Coppel Campaña S/N, Zona Nuevo Mazatlán, C.P. 82100, Mazatlán, Sinaloa, Mexico, addressed to the Personal Data Department, Monday to Friday from 9:00 am to 6:00 pm, clearly detailing the personal data with respect to which the client revokes his/her consent.
For effects of the above, the procedure and terms set forth in the section titled MEANS TO EXERCISE ARCO RIGHTS (ACCESS, RECTIFICATION, CANCELLATION AND OPPOSITION) will be applicable.
LIMITATION OF USE AND DISCLOSURE OF PERSONAL DATA
At any time the client may express his/her refusal to the treatment for the purposes that do not create a legal relation or that are not necessary for the rendering of the service, limit the use and disclosure of personal data or revoke the consent granted for the treatment of personal data, by means of a request in writing that must be submitted to the Personal Data Department to the following adress: Av. Ernesto Coppel Campaña S/N, Zona Nuevo Mazatlán C.P. 82100 Mazatlán, Sinaloa, Mexico, from 9 am to 6 pm Monday through Friday or to the e-mail email@example.com
Such request must contain at least the following: (i) Name of the Owner of the Personal Data; (ii) E-mail to receive notifications; (iii) Documents that prove the identity or authority so as to represent the owner with respect to the request; (iv) Clear and precise description of the personal data with respect to which it is intended to exercise the right and the relevant right. (v) Any other element or document that facilitates the localization of the personal data. If the request does not satisfy any of the mentioned requirements, the Personal Data Department may request within 5 days after reception of the request to provide the necessary elements or documents so as to process the same. The client will have 10 days so as to fulfill the requirement, otherwise the request will be considered as not submitted.
The maximum period of time to respond will be 20 days as of the date of reception of the request so as to communicate the determination adopted and, if the request complies with the relevant requirements, such determination will be effective 15 days after the issuance of the response. In order to protect the confidentiality, GRUPO PUEBLO BONITO will send the response to the e-mail provided and will keep the response available for the petitioner at the domicile abovementioned.
